DIGITAL MILLENNIUM COPYRIGHT ACT ("DMCA")POLICY

Peak Multifamily, LLC ("Peak Multifamily," "we," "us," or "our") respects the intellectual property rights of others and expects users of our websites, landing pages, event pages, member areas, communities, and online services to do the same.

This Digital Millennium Copyright Act ("DMCA") Policy explains how copyright owners may notify us of alleged copyright infringement and how users may submit a counter notice if they believe material was removed or disabled by mistake or misidentification. This policy is provided for informational purposes only and is not legal advice. You should consult an attorney if you have questions about your rights or obligations.

The DMCA

The DMCA creates a notice-and-takedown process that allows copyright owners or their authorized agents to ask online service providers to remove or disable access to material that allegedly infringes copyright. Before You Submit a Notice

Submitting a DMCA notice is a serious legal action. The DMCA requires certain statements to be made under penalty of perjury, and knowingly submitting false or misleading information may create legal liability.

Before submitting a takedown notice, please make sure you have a good faith belief that the use of the material is not authorized by the copyright owner, the copyright owner's agent, or the law. You should consider whether the use may be permitted by law, including fair use, and you may want to contact the person who posted the material directly if appropriate.

Please do not submit automated, bulk, or bot-generated notices without review by a trained professional. Invalid or overbroad notices can unnecessarily remove lawful content and may affect the rights of other people.

DMCA Takedown Notice

If you believe material available through Peak Multifamily's websites or services infringes your copyright, please send a written DMCA notice to us at [email protected]. Plain-text email is preferred because it helps us review and respond more quickly.

Your DMCA takedown notice should include the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by one notice, you may provide a representative list.
  • Identification of the material claimed to be infringing or the subject of infringing activity, along with information reasonably sufficient to allow us to locate the material, such as the specific URL or page where the material appears.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

By submitting a DMCA notice to us, you acknowledge that we may forward your notice, including your contact information and the information you provide, to the person or entity responsible for the material at issue or to other parties as needed to process the notice.

Counter Notice

If material you posted through Peak Multifamily's websites or services was removed or disabled in response to a DMCA takedown notice and you believe the material was removed or disabled by mistake or misidentification, you may submit a counter notice.

Your counter notice should include the following information:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled because of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, to the jurisdiction of any judicial district in which Peak Multifamily may be found.
  • A statement that you will accept service of process from the person who submitted the original DMCA notice or that person's agent.

You may submit a counter notice by email to [email protected] or by physical mail to the address listed above.

After we receive a valid counter notice, we may forward it to the person who submitted the original DMCA notice. Unless that person notifies us that they have filed a legal action seeking a court order to restrain the allegedly infringing activity, we may restore or re-enable access to the material in accordance with the DMCA, generally not less than 10 and not more than 14 business days after receipt of the counter notice.

Repeat Infringers

Where appropriate and in accordance with applicable law, Peak Multifamily may disable or terminate access for users who are repeat infringers or who repeatedly submit infringing material.
